  • Work-details such as the company you’ve worked with or are currently working with, alongside its location.
  • Other specifics of the company such as the names of the owners and the managers you’ve worked with or are currently working with.
  • Specifics of the job such as what you’ve done, how much was the agreed pay, the method of payment, and the details of the work compensation conflict.
  • Sometimes, the WHD will ask for additional documentation such as personal records of hours rendered for the company, a copy of company policies on pay, and pay stubs can help your case.

The Investigation Based On Your Complaint

When the WHD receives your complaint, they will likely conduct an investigation towards the matter. Sometimes the WHD itself conducts investigations on specific types of industries and businesses. While the companies and/or businesses investigated may differ from time to time, the process of investigation more or less remains the same:

  • Representatives of both the WHD and the business-in-question will conduct a conference to discuss and explain the investigation process.
  • The WHD representatives will then gather information based on relevant information that can be found in the business, with methods such as examining records of payroll and time, making photocopies and transcriptions of relevant information, or taking notes throughout the process.
  • The representatives will also conduct interviews with certain employees to verify the records the representatives have gathered in the previous step. This also allows them to understand in detail the kind of processes that goes on in the company with regards to pay. These interviews can be conducted within the company, by phone, via snail mail, or even at the homes of the employees themselves.
  • It’s after these examinations and interviews that the WHD will be able to determine if there have been in fact violations that were made by the company, and they will then proceed to share what these violations were and how they can be remedied.
